| The proposal is contrary
to Highland Council’s Renewable Energy Strategy in that it lies within
an area classified as having a “presumption against development” for
national and major onshore wind farm projects and therefore Policy
E7 in this strategy will apply |

| a) The visual and landscape impacts
of the proposal would be significantly detrimental, as the wind
farm would be visible from many of North Skye’s listed
walks and from the Cuillin ridge. It would also dominate the
village of Edinbane, which is sited in an Area of Great Landscape
Value (AGLV); b) The noise implications of this proposal on the
village of Edinbane will be significantly detrimental |

| The proposal is contrary to Highland
Council’s “vision” contained on page 8 of the
structure Plan, which reads ‘An emphasis on health promotion
and illness prevention”. Wind farms produce low frequency
noise, which causes ill health (Casella Stanger DEFRA Report on
low frequency noise) |

|
| The proposal is contrary to Policy
G1 in that it will not promote and enhance the social, economic
and environmental well being of the people of Edinbane. Strutt & Parker
advise that tourist business losses may result in possible bankruptcies
and predict house price diminution of up to 40% (Strutt & Parker
report for SWAG August 2002) |

| The proposal is contrary to Policy
N1 in the Highland Structure Plan in that it would:
a) have an adverse effect on the priority habitat and species defined
in Article 1 of the Habitats Directive:
b) would have an adverse impact on several Annex 1 listed species
of protected birds that use the proposed site, including the white
tailed eagle, golden eagle, hen harrier, merlin, golden plover and
migrating whooper swans. |

The proposal is contrary to Policy L4 in the Highland Structure
Plan in that it does not enhance and maintain present landscape character |
|
|
|
The proposal is contrary to Policy G6 in the Highland Structure
Plan in that it is sited on the edge of an Area of Great Landscape
Value and will neither conserve nor promote the Highland Heritage |
|
|
|
The proposal is contrary to Policy T1 in the Highland Renewable
Energy Strategy, which aims to avoid intrusive developments of wind
farms that would affect designated landscapes |
|
|
|
The proposal is contrary to Policy 2.2.20 in
the Skye and Lochalsh Local Plan in that it will be unduly conspicuous
from the A850 and is therefore contrary to the Council’s aim
of protecting scenic views seen from designated tourist routes |
|
|
|
| The proposal will adversely affect
the areas tourist industry, which is the major source of income
and employment. It is therefore contrary to Policy 2.2.19 of the
Skye and Lochalsh Local Plan in that is not consistent with the
Council’s aim to “safeguard the areas exceptional scenic
and heritage resources” |

|
| The proposal is contrary to Highland
Structure Plan Policy 2.19.2, which states “ land of a gradient
of more than 1 in 7 is not regarded as appropriate for development
due to the possible risk of future slope failure”, which
could result in a bog slide or flood affecting the village of Edinbane |
